These terms cover the nil app for iPhone and this website, nilquit.com. They are short because the app is simple: it runs on your device, there is no account, and Apple handles the money. "The developer" means the person who makes nil, TODO(owner): legal name.

who can use nil

nil is for adults 18 and older. By using it you confirm that you are at least 18. For now, nil is available only on the US App Store.

the license

nil is licensed to you, not sold, under Apple's Standard End User License Agreement. That agreement governs your use of the app. Where it and this page disagree, Apple's agreement controls.

subscriptions

not medical advice

nil provides general information and tools to help you quit nicotine. It is not medical advice, and it is not a substitute for a doctor, pharmacist or other clinician. For advice about your own health, including how to quit safely if you are pregnant, take medication or have a health condition, talk to a clinician.

no warranty

nil is provided as is and as available, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. The developer does not promise that nil will be error free or uninterrupted, or that using it will lead to any particular result. Some places do not allow the exclusion of implied warranties, so some of this may not apply to you.

limitation of liability

To the fullest extent permitted by law, the developer is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising from your use of nil or this website. To the same extent, the developer's total liability for any claim relating to nil is limited to the amount you paid for nil in the twelve months before the claim arose. Some places do not allow these limits, so some of them may not apply to you.

governing law

Apple's Standard End User License Agreement sets the governing law for the app itself. For this website, and for anything that agreement does not cover, these terms are governed by the laws of the State of TODO(owner): state, United States, without regard to its conflict-of-law rules.

If these terms change, the new version is posted on this page with a new effective date. If a future version of nil adds community features, these terms will be replaced by Terms of Service and Community Guidelines before those features arrive.
